Business Terms
Last updated: 11 October 2026 · They apply to each business from the moment it accepts them
These Business Terms govern the use of wildatlasguide.com (the "Platform") by businesses: operators, guides, owners of hides and hotspots, accommodation providers and any other company or professional that creates, claims or manages a listing, publishes products, receives booking requests or activates online payments. They complement the Terms of Use and the Privacy Policy; for anything relating to your activity as a business, these Terms prevail.
1. Who we are and who these Terms apply to
Wild Atlas Guide (Marc Martinez Moya, NIF 53314431V, c/ Pi i Margall 101, 1.º 4.ª, 08850 Gavà, Barcelona) is a wildlife discovery and eco-tourism platform that connects travellers with nature businesses. You can contact us at hello@wildatlasguide.com.
These Terms apply to anyone acting on behalf of a business. By creating or managing a business listing, you confirm that you are acting for professional purposes and that you are authorised to bind the business you represent. Businesses that activate online payments accept these Terms expressly through the checkbox shown when connecting the payment provider.
2. Your listing and business account
- Accurate information — Keep your listing accurate and up to date: name, location, activities, prices, availability, access conditions and the species that can be observed.
- Licences and permits — You must hold the licences, registrations, insurance and authorisations required by law for your activity (for example guiding, active tourism, accommodation or photography near protected species) and comply with wildlife and protected-area regulations.
- Wildlife welfare — Do not offer or promote activities that unlawfully disturb wildlife, breeding sites or protected species beyond what your authorisations allow.
- Managers — You may add other people to manage the listing. You are responsible for what they do on behalf of the business and must remove their access when they are no longer authorised.
- Review — We may review new listings and hotspots before publication and ask for documents showing your connection to the business.
3. Your content
The text, photos, logos and other content you publish remain yours. You grant us a free, worldwide, non-exclusive licence, for as long as the content is published, to host it, display it, adapt it to the Platform's format (crops, summaries for cards and search engines), translate it into the Platform's languages — including automatically, with artificial-intelligence tools — and use it to promote your listing within the Platform and on Wild Atlas Guide's own channels, referring to your business.
If you use assisted import to create a product from your website or from a text, check the result before publishing it: you are responsible for what is published in your name. You warrant that you hold the rights to the content you upload. We may correct formatting or remove content that breaches these Terms or the law, but we will not change the meaning of your text.
4. Bookings
- Requests — Travellers send you booking requests. You must accept or decline them within the stated response period (48 hours by default). If you do not respond, the request expires and any amount held is released.
- Automatic confirmation — If you turn it on, a booking paid online is confirmed and charged automatically once availability has been checked, without waiting for your acceptance.
- Prices — You set prices and currency. The price you publish must be the final price for the traveller, including mandatory taxes, and must clearly state any additional charges.
- The contract is yours — When you accept a booking, the contract for the activity or accommodation is between you and the traveller. You must provide the service as described and meet your obligations towards consumers. Wild Atlas Guide is not a party to that contract and does not provide the activity.
- Traveller data — You receive travellers' personal data (name, contact details, booking details) as an independent data controller. Use it only to manage the booking and meet your legal obligations; do not use it for marketing without their consent.
5. Online payments
Online payments are optional. This section applies only if you connect a payment provider.
5.1 Your payment provider and merchant of record
You connect your own account with a payment provider (Stripe and, when available, PayPal). Your relationship with the provider is governed by its terms. You are the merchant of record: the charge is made in your name, to your account, and the provider pays the money out to you. Wild Atlas Guide does not receive or hold travellers' funds and is not a payment institution. The payment provider's fees are yours and are deducted by the provider itself.
5.2 How charging works
- Hold on request — When a traveller requests a booking, the amount is held on their payment method without being charged.
- Charge on acceptance — The amount is charged when you accept the request. If you decline it or it expires, the hold is released and nothing is charged.
- Custom trips — A custom trip proposal already negotiated between both parties is charged when the traveller pays it, and the booking is confirmed.
- Deposit and balance — If your product requires a deposit, the balance is charged later, only when you request it from your dashboard. The Platform never charges the balance on its own.
5.3 Wild Atlas Guide commission
- Wild Atlas Guide charges a commission on each charge for one of your bookings processed online through the Platform. Having a listing, receiving requests or closing bookings paid outside the Platform carries no commission.
- Each business's first 5 paid bookings carry no commission. A booking counts once it has been charged, even if it is later refunded; the deposit and balance of the same booking count as one.
- After that, the current commission applies, as shown in the Payments section of your dashboard. It is currently 10%. An individual written agreement may set a different commission for your business.
- The commission is calculated on the amount charged (deposit and balance included), is fixed at the time of each charge and is deducted automatically by the payment provider. A change of commission never applies to charges already made.
- Where required by law, Wild Atlas Guide will issue the corresponding invoice for the commission, with any applicable taxes.
5.4 Cancellations and refunds
- You choose a cancellation policy (Flexible, Moderate or Strict), which is shown to travellers and forms part of the booking conditions.
- If the traveller cancels a paid booking, the percentage set by your policy for that notice period is refunded automatically. You can refund an additional amount from your dashboard.
- If you cancel a paid booking, the traveller automatically receives a full refund.
- For refunds processed through the Platform, the commission is returned in the same proportion. If you refund directly from your provider's dashboard, the refund is synchronised with the booking; contact us and we will return the proportional commission.
5.5 Disputes and chargebacks
As merchant of record, disputes and chargebacks are yours and you handle them with your payment provider. We will let you know when we are notified and, on request, provide the booking and conversation information we hold so you can respond.
5.6 Invoices and payment documents
For each charge, the Platform generates a payment document (invoice) in your name, using the fiscal details you provided, and a credit note for each refund. You authorise us to generate these documents and send them to the traveller on your behalf. You are responsible for keeping your fiscal details correct and for ensuring those documents meet the invoicing and tax requirements of your country; if your rules require you to issue invoices from your own system, you may do so.
5.7 Fiscal details and DAC7
To activate payments you must provide your legal or business name, tax identification number, fiscal address and country. As a platform that facilitates bookings, Wild Atlas Guide may be required by Council Directive (EU) 2021/514 (DAC7) and the national law implementing it to collect and verify these details and to report the amounts charged through the Platform to the tax authority. If so, we will give you the information reported about you. If the details are missing or cannot be verified after we have asked for them, we may suspend online payments until they are completed.
5.8 Disconnecting the provider
You can disconnect your payment provider at any time, as long as no holds, charges, refunds or balances are pending. Charges already started are completed with the provider they began with.
6. Ranking and visibility
The main parameters that determine the order in which listings and products appear are:
- Relevance to the page being viewed: species, place, country, type of activity and, where applicable, dates and season.
- The filters and sort order chosen by the user: average rating, number of reviews, likelihood of seeing the species, price or name.
- If the user does not choose an order, the average review rating, with the name as a tie-breaker.
There may be paid featured placements, for example in the home-page carousels. They are time-limited and labelled "Featured". Activating online payments or paying commission does not improve your position in the results.
7. Reviews
Reviews must reflect genuine experiences. Do not post fake reviews, do not request them in exchange for discounts or other benefits without disclosure, and do not review competitors. You may respond professionally to reviews of your business and ask us to remove a review that breaches the content standards; the decision is ours. We do not remove a review just because it is negative.
8. Restriction, suspension and termination
We may restrict, suspend or remove a listing, a feature (for example online payments) or a business account if you breach these Terms or the law, provide false information, there are signs of fraud or risk to travellers or wildlife, your payment provider restricts your account, or you accumulate well-founded complaints. We will explain the reasons by email before the measure takes effect or at the same time, and you can clarify the facts by replying to that email. To terminate a business account entirely we will give you at least 30 days' notice, unless the law requires us to act sooner, there are serious or repeated breaches, or there is a risk of fraud.
You can remove your listing or close your account at any time. Bookings already accepted and any pending payment, refund and commission obligations remain until completed.
9. Liability
We provide discovery, communication, booking and payment tools with reasonable care, but we do not guarantee uninterrupted operation and are not responsible for failures of third-party services such as payment providers. You are responsible towards Wild Atlas Guide for third-party claims caused by your activity, your content or your breach of these Terms. Except in cases of wilful misconduct or gross negligence, and to the extent permitted by law, Wild Atlas Guide's liability towards a business is limited to the commission that business paid us in the 12 months before the event giving rise to it.
10. Changes to these Terms
We will notify you by email or in your dashboard of any change to these Terms at least 15 days before it applies, or earlier if the change requires significant technical or commercial adjustments on your side. A change of commission never affects charges already made. If you do not agree, you can disconnect payments or remove your listing before the change takes effect.
11. Governing law
These Terms are governed by Spanish law. Any dispute will be submitted to the courts of the domicile of the operator of Wild Atlas Guide, unless a mandatory rule provides otherwise.
